December 7, 2020 the Constitution Association, myself, and a couple dozen others filed a lawsuit against Kamala Harris accusing her of being ineligible for office as Vice President for failure of meeting the requirement of being a Natural Born Citizen. It was filed in the Southern District Court in San Diego, and after a year in the system was dismissed. The court claimed that the responsibility to determine eligibility resided with Congress, and the lawsuit pitted the courts against Congress, violating the constitutional concept of separation of power; a condition the judge called, “Political Question.”
In the appeal to the Ninth Circuit Court of Appeals, I argued in the new filing that no power to determine eligibility has been granted to Congress by the Constitution, leaving the authority as per the 10th Amendment with the States, or to the people. Since the States have not properly carried out their constitutional task of keeping her off the ballot due to ineligibility, the responsibility fell upon the people; Hence, our lawsuit. The Ninth Circuit dismissed the case using the district court’s argument, and then adding that we did not have standing; a false argument since the Constitution Association as one of the complainants could show tangible injury in the form of volunteer hours and money spent in response to the unlawful action by Kamala Harris of running for office as Vice President without meeting eligibility requirements.
A little over a year and a half ago we filed a writ of certiorari to the United States Supreme Court – a request for them to review whether or not the case is worth reviewing for them taking it. We have received no response since, despite inquiring with a couple follow-up letters in the hopes of “rattling the cage” of the Supreme Court. I have a feeling the case has been put on a shelf somewhere, forgotten or avoided so as to not rock the boat of political theory.
