As a guest on Fox News, Hannity (guest hosted by Jason Chaffetz) on December 20, 2024, Conservative Fox News Contributor Joey Jones said that at one time the Biden Administration was “giving away” unused sections of the Border Wall that remains on the ground near the border since the Democrats refused to follow the law and erect the wall. Now, the Biden administration is, during its final month in office, sticking it to voters and the incoming Trump administration by hauling away massive amounts of border wall materials to be sold off at government auctions for pennies on the dollar. The resistance against Trump’s upcoming efforts to secure the border is an effort, according to Representative Eli Crane (R-AZ), to purposefully hamstring Trump before he takes office. He told the Daily Wire, “The Biden Administration is well aware they shouldn’t have reversed the construction of the border wall. If it’s true, they’re purposefully hamstringing an incoming president, it wouldn’t be shocking. Why would they want to see President Trump succeed with policies they aggressively sabotaged?” Crane also called the last-minute fire sale “a direct affront to the will of the people.”
A long-time border patrol agent said, “When Trump comes back, and he wants to start the border wall all over again, the whole entire funding fight is gonna happen again. That’s their play. He’s gonna have to fight for this — again.”
In response, Donald Trump has launched a lawsuit designed to stop the sale of materials to private parties, arguing that the move is “possibly criminal,” and that “The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of the Defendant’s conduct.”
The court filing also states that Biden is “deliberately selling off border-wall materials at a major financial loss to the Government to obstruct the pro-wall policy of Congress and President Trump, such conduct likely constitutes a criminal act, such as a conspiracy to defraud the United States…At the very least, the reported conduct raises troubling concerns of potentially criminal behavior.”
The conduct is nothing new. The Biden administration began placing parts of the border wall on the auction block last year. The U.S. Department of Defense states that the agency has no choice because of the 2024 National Defense Authorization Act, which states the agency must, “submit a plan to use, transfer or donate all remaining wall material purchased with Pentagon funds.”
Constitutionally, the move would be unconstitutional because the money was originally appropriated for the purpose of erecting the wall for border security; the only reason it is not unconstitutional is because a new piece of legislation (the NDAA) changed the appropriation of the funds and allows for the materials to be sent to ownership in the private sector.
Despite the legality, however, the reality is that the Court of Public Opinion is watching, and this kind of un-American garbage is a large part of why the Democrats lost in November and will continue to lose until they shift gears against their Anti-American policies.
